Preview/Open-House - Any Monday-Friday from 9AM until 5PM prior to the auction. Our gates will be open for preview.
Pickup/Removal - 3 Day Pickup - Wednesday, July 22nd / Thursday, July 23rd / Friday, July 24th from 9AM until 6PM - Pickup by appointment only. You will receive an email and text after the auction to choose your pickup time.
Please Note: All items are sold as-is and where-is with no warranty expressed or implied. There is a 15% buyer premium that applies to all purchases, as does VA sales tax. Receive a 3% discount off the premium by paying with cash or good check. Bring your ST-10 or ST-18 for tax exempt.

Acceptance of Terms
By registering for this auction, placing a bid, or purchasing any item, you acknowledge that you have read, understand, and agree to these Terms and Conditions. Registration and bidding constitute a legally binding contract between the bidder and Lucky Dog Auction & Realty, Inc.
All Property Sold AS-IS
All items are sold AS-IS, WHERE-IS, WITH ALL FAULTS, with no warranties or guarantees of any kind, either expressed or implied.
Lucky Dog Auction & Realty makes no representations or warranties regarding, but not limited to:
- Condition
- Age
- Hours
- Mileage
- Mechanical condition
- Functionality
- Safety
- Merchantability
- Fitness for a particular purpose
- Completeness
- Accuracy of descriptions
- Emissions compliance
- Roadworthiness
The buyer is solely responsible for determining the condition, value, and suitability of each item before bidding.
Equipment Condition Disclaimer
Equipment sold at auction is primarily used equipment. Buyers should expect normal wear, cosmetic defects, scratches, dents, faded paint, rust, fluid leaks, repairs, missing parts, worn components, and other imperfections consistent with age and prior use unless specifically stated otherwise.
Lucky Dog Auction & Realty makes no guarantee regarding the operational condition, mechanical integrity, serviceability, or remaining useful life of any item.
Inspection (Preview)
Inspection dates and times are provided for the benefit of bidders.
All bidders are strongly encouraged to personally inspect items prior to bidding.
Failure to inspect an item does not relieve the buyer of responsibility for purchasing it.
Unless specifically stated otherwise, equipment has not been inspected, serviced, tested, or certified by Lucky Dog Auction & Realty.
Item Descriptions
Descriptions, photographs, videos, serial numbers, measurements, specifications, and condition reports are believed to be accurate but are provided solely as a courtesy.
They are not guaranteed.
Lucky Dog Auction & Realty shall not be responsible for errors, omissions, inaccuracies, or differences in opinion regarding condition.
Buyers are responsible for verifying all information prior to bidding.
Hour Meter / Odometer Disclaimer
Hour meter readings, odometer readings, and mileage are provided as a convenience only and are not guaranteed. Meters may have been replaced, disconnected, repaired, reset, or may not accurately reflect actual usage.
Emissions & Regulatory Compliance
Lucky Dog Auction & Realty makes no representation or warranty that any item complies with EPA emissions standards, OSHA requirements, DOT regulations, safety standards, inspections, licensing requirements, or any other federal, state, or local regulations.
Compliance is solely the responsibility of the purchaser.
Registration Authorization
A temporary authorization may be placed on the credit card used during registration.
This authorization is not a charge and will be released by your financial institution according to its own policies.
Bidding
You must be registered to bid.
Every bid placed is:
- Final
- Irrevocable
- Legally binding
Bids may not be withdrawn or cancelled.
If you are the high bidder when bidding closes, you are legally obligated to purchase that item.
Failure to complete payment may result in:
- Suspension or permanent revocation of bidding privileges
- A $50 account reactivation fee
- Collection activity
- Legal action
- Recovery of collection costs and attorney's fees where permitted by law
Auction Closing
Lots close on a staggered schedule.
Each lot features a soft close.
If a bid is received during the final minute of bidding, that lot will automatically extend for an additional one (1) minute. Extensions continue until no further bids are received.
The Auctioneer reserves the right to modify closing times if necessary.
Buyer's Premium & Sales Tax
A 15% Buyer's Premium will be added to every purchase.
A 3% Buyer's Premium discount will be given for payments made by cash or approved check.
Virginia sales tax will be collected unless a valid exemption certificate has been received prior to payment.
Payment
Payment in full must be received no later than the close of business on Friday, July 24, at 6:00 PM, unless otherwise announced by the Auction Company.
Accepted forms of payment include:
- Cash
- Approved Check
- Wire Transfer
- Visa
- MasterCard
- Discover
Credit card payments are limited to a maximum of $5,000.00 per invoice.
Credit card payments must be made in person by the registered purchaser.
The name on the credit card must match the registered bidder, and the purchaser must present a valid government-issued photo ID (such as a driver's license) at the time of payment.
Lucky Dog Auction & Realty reserves the right to require payment by wire transfer, certified funds, cash, or other guaranteed funds for any purchase regardless of amount.
The Auction Company also reserves the right to charge the credit card on file for unpaid invoices where authorized.
Failure to pay by the stated deadline may result in suspension or revocation of bidding privileges, a $50 account reactivation fee, collection activity, and legal action.
Pickup Schedule
Pickup will be held:
Wednesday, July 22 — 9:00 AM to 6:00 PM
Thursday, July 23 — 9:00 AM to 6:00 PM
Friday, July 24 — 9:00 AM to 6:00 PM
All purchased items must be removed during the published pickup dates and times unless prior arrangements have been approved by Lucky Dog Auction & Realty.
Buyers are responsible for bringing adequate trailers, chains, binders, straps, tools, labor, and any equipment necessary to safely remove and transport their purchases.
Loading Assistance
As a courtesy, Lucky Dog Auction & Realty may provide loading assistance using forklifts, skid steers, telehandlers, tractors, or other equipment when available.
Loading assistance is provided solely at the buyer's request and entirely at the buyer's risk.
The buyer assumes all responsibility and liability for any damage to purchased items, trailers, vehicles, equipment, property, or personal injury that occurs during loading.
Lucky Dog Auction & Realty reserves the absolute right to refuse any loading request if, in its sole judgment, the loading operation is unsafe, exceeds the capacity of available equipment, could damage property, or presents an unreasonable risk to persons or equipment.
Once an item has been loaded, secured, or leaves the auction premises, the buyer assumes full responsibility for its safe transportation.
Removal Deadline
All purchased items must be removed during the published pickup dates and times unless prior written arrangements have been approved by Lucky Dog Auction & Realty.
Failure to remove purchased property by the removal deadline may result in reasonable storage, handling, transportation, relocation, and administrative fees at the Auction Company's sole discretion.
Any costs incurred by Lucky Dog Auction & Realty to move, store, secure, or otherwise handle property not removed by the purchaser shall be the sole responsibility of the purchaser.
Items remaining on the auction site more than seven (7) calendar days after the final scheduled pickup day, without prior written approval, shall be considered abandoned.
Abandoned property shall become the sole property of Lucky Dog Auction & Realty and may be resold, disposed of, or otherwise handled without refund, compensation, or further notice to the purchaser.
The purchaser shall remain liable for any unpaid balances, storage charges, transportation costs, disposal fees, and any other expenses incurred by the Auction Company as a result of the purchaser's failure to timely remove purchased property.
Titles & Ownership Documents
Any available titles, certificates of origin, or ownership documents will be released only after payment has been received in full and all funds have cleared.
The buyer is solely responsible for registration, titling, licensing, inspections, taxes, and compliance with all applicable federal, state, and local laws.
Lucky Dog Auction & Realty makes no guarantee that any item is eligible for registration or highway use unless expressly stated in the lot description.
Risk of Loss
Ownership and all risk of loss pass to the successful bidder immediately upon the Auctioneer's declaration of "Sold," regardless of when the item is removed from the auction site.
The purchaser assumes all responsibility for loss, theft, vandalism, damage, or destruction after the item has been sold.
Default by Buyer
If the purchaser fails to pay for or remove purchased property, Lucky Dog Auction & Realty may, at its sole discretion:
- Cancel the sale
- Resell the property
- Retain previous payments where permitted by law
- Recover any deficiency
- Charge storage and handling fees
- Suspend or permanently revoke bidding privileges
- Pursue legal remedies to recover all damages, collection costs, and attorney's fees where permitted by law
Chargebacks
By registering and bidding, the purchaser agrees not to initiate a credit card chargeback without first contacting Lucky Dog Auction & Realty to attempt to resolve the matter.
The purchaser acknowledges that all property is sold AS-IS, WHERE-IS, WITH ALL FAULTS, and that bidding constitutes acceptance of these Terms and Conditions.
Improper chargebacks may result in suspension of bidding privileges, collection activity, legal action, and recovery of all associated costs and attorney's fees where permitted by law.
Technology Disclaimer
Lucky Dog Auction & Realty shall not be responsible for:
- Internet interruptions
- Computer failures
- Software malfunctions
- Mobile device failures
- Power outages
- Lost internet connections
- Delayed bids
- Website interruptions
The Auction Company reserves the right to extend bidding, reopen bidding, delay closing, or withdraw lots due to technical difficulties.
Auctioneer's Discretion
Lucky Dog Auction & Realty reserves the right to:
- Reject any bid
- Remove any item
- Cancel any lot
- Resolve bidding disputes
- Reopen bidding
- Divide or combine lots
- Correct clerical errors
- Refuse service to any bidder
- Modify auction terms when necessary
The Auctioneer's decisions shall be final.
Limitation of Liability
Lucky Dog Auction & Realty, its employees, agents, consignors, and affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from participation in this auction.
The maximum liability of Lucky Dog Auction & Realty shall not exceed the purchase price actually paid for the specific item giving rise to the claim.
Privacy
Personal information collected during registration is used solely for conducting auctions, processing payments, and communicating with customers.
Lucky Dog Auction & Realty does not sell customer information to third parties except as required by law or as necessary to process auction transactions.
Governing Law
These Terms and Conditions shall be governed by the laws of the Commonwealth of Virginia.
Any legal action arising from this auction shall be brought exclusively in a court of competent jurisdiction located in Franklin County, Virginia.
