Our goal is to make every auction fair, efficient, and enjoyable for everyone involved. These Terms & Conditions are intended to help us conduct auctions smoothly, treat every bidder equally, and keep pickup organized for our sellers, buyers, and staff. We appreciate your understanding and cooperation.

By registering and placing a bid, you acknowledge that you have read, understood, and agree to the following Terms & Conditions.

Auction Schedule

BIDDING OPENS:
Wednesday, October 14, 2026, at 7:00 PM

BIDDING CLOSES:
Wednesday, October 28, 2026, beginning at 7:00 PM

PREVIEW DATES:

• Saturday, October 24, 2026, from 9:00 AM to 11:00 AM

• Wednesday, October 28, 2026, from 2:00 PM to 5:00 PM

PICKUP DATES:

• Thursday, October 29, 2026, from 9:00 AM to 5:00 PM

• Friday, October 30, 2026, from 9:00 AM to 12:00 PM (NOON)

IMPORTANT: This is an off-site farm equipment auction. All purchases must be removed during the scheduled pickup periods unless prior arrangements have been approved by Lucky Dog Auction & Realty, Inc.

All times are Eastern Time.

Buyer's Premium

A Buyer's Premium will be added to all purchases.

• 15% when paying by credit or debit card

• 12% when paying by cash, check, cashier's check, or wire transfer

Applicable Virginia sales tax will be collected unless a valid and applicable Virginia sales tax exemption certificate is provided prior to payment.

Credit Card Authorization

A $50.00 credit card authorization may appear as a pending transaction when you register to bid. This is not a charge and is used only to verify that your payment method is valid.

Lucky Dog Auction & Realty, Inc. does not collect or retain these funds. The authorization will typically disappear within 1–2 business days, depending on your financial institution.

If you do not make any purchases, you will not be charged.

Payment

ALL INVOICES MUST BE PAID IN FULL NO LATER THAN FRIDAY, OCTOBER 30, 2026, AT 12:00 PM (NOON).

PAYMENT IN FULL IS REQUIRED BEFORE ANY PURCHASED ITEMS WILL BE RELEASED OR LOADED.

Buyers picking up purchases on Thursday, October 29, or Friday, October 30, must pay their invoices in full before removing any items from the auction property.

Accepted forms of payment include:

• Cash

• Check

• Cashier's Check

• Visa

• Mastercard

• Discover

• Wire Transfer ($20.00 wire transfer fee applies)

Credit card payments are limited to $5,000.00.

Lucky Dog Auction & Realty, Inc. reserves the right to require certified funds or wire transfer for certain purchases.

Payments made by check or wire transfer may be subject to verification or clearance before items are released.

IMPORTANT: THE FINAL PAYMENT DEADLINE DOES NOT EXTEND THE SCHEDULED PICKUP PERIOD.

Buyers must complete payment and remove their purchases no later than Friday, October 30, 2026, at 12:00 PM (NOON), unless prior arrangements have been approved by Lucky Dog Auction & Realty, Inc.

Item Condition — Farm Equipment & Machinery

ALL ITEMS ARE SOLD AS-IS, WHERE-IS, WITH ALL FAULTS, WITHOUT WARRANTIES OR GUARANTEES OF ANY KIND, EXPRESS OR IMPLIED.

This auction includes farm equipment, machinery, implements, tools, and other personal property that may be used, aged, damaged, incomplete, or in need of repair.

Lucky Dog Auction & Realty, Inc. makes no warranties or guarantees regarding:

• Mechanical or operating condition

• Engine, transmission, or hydraulic performance

• Actual operating hours or mileage

• Tires, tracks, brakes, or steering systems

• Structural integrity or previous repairs

• Completeness of equipment or attachments

• Fitness for a particular purpose

• Ability of equipment to start, run, drive, lift, or operate as intended

• Compliance with current safety or operational standards

While every effort is made to provide accurate descriptions and photographs, all information is provided as a guide only and should not be relied upon as a substitute for personal inspection.

Hour meter readings, mileage, model years, serial numbers, and other identifying information are provided when available but are not guaranteed.

Unless specifically stated otherwise, items have not been tested or inspected for mechanical soundness.

Bidders are strongly encouraged to attend one of the scheduled previews and inspect items thoroughly before placing bids.

ALL SALES ARE FINAL. NO RETURNS, REFUNDS, EXCHANGES, OR PRICE ADJUSTMENTS.

Preview & Inspection

Preview will be available during the following scheduled times:

• Saturday, October 24, 2026 — 9:00 AM to 11:00 AM

• Wednesday, October 28, 2026 — 2:00 PM to 5:00 PM

Bidders are encouraged to personally inspect all items before bidding.

This auction is being conducted at a farm property. Visitors should be aware of uneven terrain, farm equipment, potential trip hazards, and other conditions commonly associated with agricultural properties.

Visitors must remain within designated auction and preview areas and follow all instructions from auction personnel.

Inspection of equipment is at the bidder's own risk, to the fullest extent permitted by law.

Bidding

Every bid placed constitutes a legally binding commitment to purchase the item if declared the successful bidder.

Please bid carefully.

BIDS CANNOT BE CANCELED OR WITHDRAWN.

Bidders are responsible for reviewing descriptions, photographs, auction terms, and all available information before placing bids.

Lucky Dog Auction & Realty, Inc. reserves the right to refuse, suspend, or revoke bidding privileges at its sole discretion.

Online Bidding

This is an online-only auction featuring staggered closing times and automatic bid extensions.

BIDDING BEGINS CLOSING WEDNESDAY, OCTOBER 28, 2026, AT 7:00 PM.

If a bid is placed during the final seconds of a lot, bidding will automatically extend according to the auction platform's settings to provide all bidders a fair opportunity to continue bidding.

Lots will continue closing until all bidding has concluded.

Lucky Dog Auction & Realty, Inc. is not responsible for internet outages, software malfunctions, technical difficulties, server failures, power outages, or missed bids resulting from circumstances beyond our control.

We strongly encourage bidders not to wait until the final seconds to place bids.

Pickup & Removal

PICKUP IS AVAILABLE DURING THE FOLLOWING TIMES ONLY:

• THURSDAY, OCTOBER 29, 2026 — 9:00 AM TO 5:00 PM

• FRIDAY, OCTOBER 30, 2026 — 9:00 AM TO 12:00 PM (NOON)

THIS IS AN ON-SITE FARM EQUIPMENT AUCTION WITH STRICTLY ENFORCED PICKUP HOURS.

All buyers are responsible for making the necessary arrangements to retrieve their purchases during the scheduled pickup periods.

If you cannot personally attend pickup, you must arrange for someone else to retrieve your purchases on your behalf.

ALL ITEMS MUST BE REMOVED FROM THE PROPERTY BY 12:00 PM (NOON) ON FRIDAY, OCTOBER 30, 2026, UNLESS PRIOR ARRANGEMENTS HAVE BEEN APPROVED BY LUCKY DOG AUCTION & REALTY, INC.

Payment must be completed before any items will be released or loaded.

The auction property is not a storage facility, and buyers should not assume additional pickup days will be available.

Items not removed during the scheduled pickup periods without prior approved arrangements will be considered abandoned and forfeited without refund, to the extent permitted by law.

Lucky Dog Auction & Realty, Inc. reserves the right to charge the credit card used to register for unpaid invoice balances, buyer's premiums, applicable sales tax, storage fees, disposal fees, and other charges authorized under these Terms & Conditions.

The auction company reserves the right to resell, retain, donate, recycle, or otherwise dispose of abandoned purchases without further notice, subject to applicable law.

Failure to remove purchased items during the designated pickup periods may result in suspension or permanent revocation of bidding privileges.

Loading Assistance & Liability

LUCKY DOG AUCTION & REALTY, INC. WILL HAVE EQUIPMENT AVAILABLE ON-SITE TO ASSIST WITH LOADING PURCHASED ITEMS.

Loading assistance is provided as a courtesy to our buyers and is not guaranteed.

ALL LOADING ASSISTANCE IS PROVIDED AT THE BUYER'S RISK, TO THE FULLEST EXTENT PERMITTED BY LAW.

Buyers are responsible for bringing suitable trucks, trailers, chains, straps, tie-downs, and any additional labor or equipment necessary to safely remove and transport their purchases.

By requesting or accepting loading assistance, buyers acknowledge and agree to the following:

1. Damage to Equipment or Property

To the fullest extent permitted by law, Lucky Dog Auction & Realty, Inc., its employees, representatives, and the property owner disclaim responsibility for damage to purchased items, trucks, trailers, vehicles, equipment, or other property occurring during loading, unloading, or removal.

This includes damage that may occur while equipment is being lifted, moved, positioned, or placed onto a vehicle or trailer, except where liability cannot legally be excluded.

2. Personal Injury

Buyers acknowledge that loading heavy equipment and machinery involves inherent risks, including equipment movement, falling objects, shifting loads, and potential personal injury.

Buyers assume the risks associated with loading and removal activities to the fullest extent permitted by law.

3. Right to Refuse Loading Assistance

LUCKY DOG AUCTION & REALTY, INC. RESERVES THE ABSOLUTE RIGHT TO REFUSE, LIMIT, OR DISCONTINUE LOADING ASSISTANCE AT ANY TIME.

Our employees will not be required to perform any loading operation they consider unsafe, unreasonable, or beyond the capabilities of the equipment available.

This includes, but is not limited to:

• Improperly sized or overloaded trailers

• Unsafe or unstable loads

• Equipment exceeding the lifting capacity of available machinery

• Items lacking safe lifting or attachment points

• Loads that cannot be properly balanced or secured

• Loading situations that could result in damage to property, equipment, or personal injury

• Any other situation deemed unsafe by auction personnel

OUR STAFF HAS THE FINAL SAY REGARDING WHETHER LOADING ASSISTANCE CAN BE SAFELY PROVIDED.

Buyers may not pressure, demand, or require auction personnel to perform loading operations that staff considers unsafe.

4. Buyer Responsibility

If loading assistance is refused or unavailable, the buyer remains responsible for arranging safe removal of their purchases within the scheduled pickup periods unless alternative arrangements are approved in advance.

5. Securing Loads

Buyers are solely responsible for ensuring that all equipment and purchases are properly loaded, balanced, secured, and transported in compliance with applicable laws and regulations.

Auction staff is not responsible for securing loads or verifying that a buyer's vehicle, trailer, or load is roadworthy.

6. Property Damage

Buyers are responsible for damage they or their representatives cause to buildings, fences, gates, fields, driveways, utilities, landscaping, or other property during removal.

7. Verification of Purchases

Before leaving the auction site, buyers are responsible for verifying that they have received all purchased items.

Lucky Dog Auction & Realty, Inc. is not responsible for locating, storing, replacing, or refunding items inadvertently left behind.

IMPORTANT: THE AVAILABILITY OF LOADING EQUIPMENT DOES NOT GUARANTEE THAT EVERY ITEM CAN OR WILL BE LOADED BY AUCTION PERSONNEL.

Farm Property & Site Conditions

This auction is being conducted at an off-site farm location.

Buyers and their representatives acknowledge that farm properties may contain uneven terrain, gravel roads, soft ground, mud, ditches, overhead obstructions, fences, gates, and other potential hazards.

All buyers enter and use the property at their own risk, to the fullest extent permitted by law.

Buyers are responsible for determining whether their vehicles, trailers, and equipment are suitable for accessing the property and removing their purchases.

Lucky Dog Auction & Realty, Inc. is not responsible for vehicles or trailers becoming stuck, damaged, or otherwise unable to access or leave the property, except where liability cannot legally be excluded.

Buyers must remain within designated access areas and follow instructions from auction personnel.

Any damage caused to the property by a buyer or the buyer's representatives will be the responsibility of that buyer.

Titled Vehicles & Equipment

If any vehicles, trailers, or equipment requiring a certificate of title are offered in this auction, title information will be provided when available.

Buyers are responsible for verifying title status and requirements before bidding.

Unless specifically stated otherwise, buyers are responsible for all applicable title fees, registration fees, taxes, inspections, and transfer expenses.

Titles will not be released until payment has been received in full and any required payment clearance period has passed.

No representations are made regarding the ability to register or title any item unless specifically stated in the auction listing.

Transportation & Shipping

NO SHIPPING IS PROVIDED FOR THIS AUCTION.

Buyers are solely responsible for arranging transportation of all purchased items.

Lucky Dog Auction & Realty, Inc. does not provide hauling or delivery services for this auction unless specifically agreed to in writing.

Any third-party transportation arrangements are the responsibility of the buyer.

All purchases must be removed during the scheduled pickup periods unless prior arrangements have been approved by the auction company.

Failure to Pay

ALL PURCHASES MUST BE PAID IN FULL BY FRIDAY, OCTOBER 30, 2026, AT 12:00 PM (NOON).

Failure to make payment by the deadline may result in:

• Suspension or permanent revocation of bidding privileges

• The credit card on file being charged for outstanding balances

• Collection of unpaid invoice amounts

• Additional fees or collection expenses as permitted by law

• Legal action or collection efforts, if necessary

Winning bidders remain responsible for their purchases even if they fail to pay or remove the items.

Lucky Dog Auction & Realty, Inc. reserves the right to pursue available remedies for nonpayment or breach of these Terms & Conditions.

Auctioneer's Rights

Lucky Dog Auction & Realty, Inc. reserves the right to:

• Correct catalog errors or omissions

• Withdraw items before or during the auction

• Reject or refuse any bid

• Resolve bidding disputes

• Cancel or reopen bidding when necessary

• Combine or divide lots

• Refuse service to any person

• Refuse unsafe loading or removal requests

• Establish reasonable procedures necessary to protect the auction property, buyers, sellers, and staff

The Auctioneer's decisions regarding auction operations and bidding disputes are final, subject to applicable law.

Limitation of Liability

Lucky Dog Auction & Realty, Inc. acts solely as agent for the seller.

To the fullest extent permitted by applicable law, Lucky Dog Auction & Realty, Inc. is not responsible for errors in descriptions, internet interruptions, technical failures, accidents, theft, weather events, acts of God, or damages arising from participation in the auction.

Buyers acknowledge that farm equipment and machinery may present significant risks during inspection, operation, loading, and transportation.

As between buyer and seller, responsibility and risk of loss for purchased items transfers to the buyer immediately upon being declared the successful bidder, regardless of when the items are paid for or removed from the auction site, to the extent permitted by law.

Nothing in these Terms & Conditions is intended to exclude liability that cannot legally be excluded.

Acceptance of Terms

By registering for and participating in this auction, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

You acknowledge that:

• All items are sold AS-IS, WHERE-IS, with no warranties or guarantees.

• All sales are final.

• Full payment is required before removal of any purchased items.

• The final payment deadline is Friday, October 30, 2026, at 12:00 PM (NOON).

• Pickup is Thursday, October 29, from 9:00 AM until 5:00 PM, and Friday, October 30, from 9:00 AM until 12:00 PM (NOON).

• All purchases must be removed by Friday, October 30, at 12:00 PM (NOON), unless prior arrangements are approved.

• Loading assistance is provided as a courtesy and at the buyer's risk, to the fullest extent permitted by law.

• Lucky Dog Auction & Realty, Inc. reserves the right to refuse unsafe loading requests.

• Buyers are responsible for safely transporting and securing their purchases.

• Failure to pay or remove purchases may result in additional fees, forfeiture, and loss of bidding privileges, subject to applicable law.

You authorize Lucky Dog Auction & Realty, Inc. to charge the credit card used to register for purchases, buyer's premiums, applicable sales tax, unpaid invoice balances, and any fees authorized under these Terms & Conditions.
